Child custody and visitation rights – fighting for yours

Child custody and visitation will depend on what is in the best interests of the children. Generally the Family Court will attempt to do what is best for the children with the aim of not upsetting the visitation arrangements they are already used to.

After considering this, the Family Court will award custody to the parent who is best able to provide the primary care that the children require to develop properly. The Family Court will also do their best to ensure the children retain contact with both parents subject to any problems that may arise.
